1. General conditions

Welcome to Swyftshop (“we”, “us”, “our”). By accessing or using the Swyftshop website (the “Site”), you agree to comply with and be bound by these Terms of Service (“Terms”). Swyftshop is a silent luxury atelier dedicated to objects that blend minimalism, craft, and sustainability. These Terms apply to all visitors, users, and customers who engage with our products and content.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site after any changes constitutes acceptance of the new Terms. We encourage you to review this page periodically.

2. Use of our site & eligibility

By placing an order or browsing Swyftshop, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction (including copyright and trade regulations).

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without express written permission by Swyftshop. Our visual identity, product designs, and editorial content are protected under intellectual property laws.

3. Products, pricing & availability

All product descriptions, images, and pricing are subject to change at any time without notice. We make every effort to display the colors and materials accurately, but screen variations may occur. Swyftshop items are made in small batches — we embrace organic irregularities as a mark of authenticity.

Prices are quoted in USD and do not include applicable taxes or shipping fees, which will be added at checkout. We reserve the right to limit quantities of any product or service, and to discontinue any item at any time. In the event of a pricing error, we will contact you before fulfillment.

4. Orders, payments & returns

4.1 Order acceptance

After you place an order, you will receive an email acknowledgment. This does not signify our acceptance of your order. We reserve the right to refuse or cancel any order for reasons including but not limited to product availability, payment issues, or suspected fraud.

4.2 Payment methods

We accept major credit cards, PayPal, and other secure payment gateways. All transactions are encrypted and processed securely. By submitting payment details, you represent that you are authorized to use the selected payment method.

4.3 Return & exchange policy

Swyftshop accepts returns within 14 days of delivery for unused, unwashed items in original packaging. Final sale items (including candles, diffusers, and personalized objects) cannot be returned. To initiate a return, contact our studio at care@Swyftshop.com. Refunds are processed to the original payment method within 10 business days after inspection.

5. Shipping & delivery

We ship worldwide from our atelier hubs. Estimated delivery times are provided at checkout but are not guaranteed. Swyftshop is not responsible for delays caused by customs, carriers, or unforeseen events. You are responsible for any customs duties or import taxes applicable to your region.

Tracking information will be sent once your order is dispatched. If a package is lost in transit, please contact us and we will work with the carrier to resolve the issue. Risk of loss passes to you upon delivery to the carrier for shipments.

6. Intellectual property & brand identity

All content on this Site — including but not limited to logos, graphics, photography, text, product designs, and the “Swyftshop” trademark — is the exclusive property of Swyftshop Atelier. You may not reproduce, distribute, or create derivative works without our prior written consent. The unique name “Swyftshop” and our visual identity embody our commitment to silent luxury and sustainable craft; any unauthorized use is strictly prohibited.

We welcome press and editorial features, but prior approval is required for commercial use of our brand assets.

7. User comments & feedback

If you submit reviews, suggestions, or other creative ideas, you grant Swyftshop a non-exclusive, royalty-free, perpetual license to use, modify, and publish them. We reserve the right to remove any content that is offensive, illegal, or violates third-party rights. We appreciate genuine feedback — it helps us refine our practice.

8. Disclaimer of warranties; limitation of liability

Swyftshop provides the Site and all products on an “as is” and “as available” basis. We do not warrant that the service will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

In no case shall Swyftshop, our directors, employees, or suppliers be liable for any indirect, incidental, or consequential damages arising from your use of any product or service, even if advised of the possibility. Our total liability shall not exceed the amount you paid for the product giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Swyftshop and its affiliates from any claim or demand made by any third party due to or arising out of your breach of these Terms or violation of any law or rights of another party.

10. Governing law & dispute resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site shall be resolved exclusively through binding arbitration in New York County, unless otherwise agreed in writing. Small claims actions may be brought in your local jurisdiction.

You acknowledge that any breach of our intellectual property rights may cause irreparable harm, and we may seek injunctive relief without the necessity of posting bond.

11. Severability & entire agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and Swyftshop regarding the use of our Site and supersede any prior agreements.
